Terms

The following terms apply to all studio-based, location and set based photography and video appointments and projects. They are on behalf of TWO-D PHOTOGRAPHY LTD.

STUDIO 

Every voucher has a three-month expiry on it from purchase, unless otherwise stated. Our corporate vouchers only have no expiry. This means all vouchers must be booked into the diary during this period. Whether or not the session takes place during this time, or after, is down to the discretion and judgment of the studio manager.

Every studio session must be accompanied by a separate ordering appointment at the clients convenience. There is only one 60 minute appointment per session per client, so any orders must be placed at the ordering appointment. This must take place within 4 weeks of the studio date.

Sometimes due to unique circumstances, ordering deadline may be extended at the discretion of the Studio Director.

Images for orders including and over the value of £600 will be stored indefinitely on our servers. Orders under this value will remain on our system for THREE DAYS after the ordering session, unless otherwise agreed. After this period they will be removed and erased. We are not obliged to store any images and do so only at the discretion of the Studio Director. Payment plans or extensions on ordering times can be agreed in principle, and we would encourage anyone wishing to place an order but facing financial restraints at the time to discuss your options with us – we are here to help.

All vouchers must be used, and their contents ordered, within two weeks from the ordering appointment and/or from the time the images are first viewed via email. Any orders placed after this time cannot use the vouchers or what they include, as they will be expired, null and void.

Vouchers cannot be used in conjunction with any other offer. No vouchers can be used in conjunction with any existing offer, including our £50 and £100 gift vouchers.

The voucher is for a ‘full family shoot’ which means all immediate members of the family must attend. If they do not and anyone is missing, it is to the discretion of the studio manager and attending photographer whether or not the voucher is valid and can be used. Two-D Photography is well within their right to refuse attendees on these grounds. For example, an actor requiring headshots cannot use a studio voucher towards this brief, as it is a separate requirement. 

Vouchers may be given as a gift if not intended for use by initial recipient.

Two-D Photography or any staff member are within their right to refuse to photograph any session, person, pet or item for any reason given.

Only ONE session may be used per family per person every 12 months.

If for any reason the session does not go as planned (e.g. baby crying, clients unwell, injury or any other reason not given), the photographer has the right to cancel the session without warning or rebook the appointment for another time.

All clients that use this voucher do so understanding that our photography involves physical movement and at times lots of energy. As such, Two-d photography Ltd. and two-D Creative Ltd. Does not accept any responsibility for injury or injuries sustained during the photo shoot and cannot be held liable in this regard. If any attendee has a history of illness or physical defect, this should be discussed in full with your photographer before attending.

All artwork and digital manipulation of the images from the session are to the full discretion of the editor/photographer. We will try to apply requests where possible, but ultimately the outcome of the images cannot be guaranteed to any specific request or style other than that chosen by the staff member who works on the images. Editing to images can only be applied to ordered images.

Our £100 gift voucher value is the cash value of the gift card and £100 is also the cost of a sitting or session in the studio for a 1-hour dedicated appointment slot. If another agreement is in place or another package has already been purchased, this can be used towards ANY product in our range, but not towards any other goods or services.

Any client who undertakes a photoshoot at two-d photography or at the studio agrees that their images can be used to promote and market for Two-D Photography exclusively. Information and date will NEVER be sold or passed onto a third party at any time. IF YOU DO NOT WISH FOR YOUR IMAGES TO BE USED TO PROMOTE AND MARKET TWO-D PHOTOGRAPHY LTD. YOU MUST LET US KNOW VIA THE MEANS BELOW.

 

WEDDING PHOTOGRAPHY 

The terms for such bookings are listed in specific contracts for each wedding booked, but an overview of the most basic terms are as follows. 

ENTIRE AGREEMENT:

The contract represents an understanding between TWO-D PHOTOGRAPHY LTD. and THE COUPLE TO BE MARRIED. It reinstates all prior and simultaneous agreements between parties. Any changes made to this document must be done so in writing and signed by both parties.

RESERVATION:

TWO-D PHOTOGRAPHY LTD. will reserve the time and date agreed upon and will not make any other reservations. For this reason, the reservation retainer is non-refundable in the event of a cancellation.

CANCELLATION:

In the event that the agreement, as outlined in this contract, is cancelled before the wedding ceremony takes place, the retainer will be forfeit. A cancellation fee of £300 will be due on cancellation date. If the contract and balances can be transferred to a new mutually available date, the retainer will be transferred free of charge where possible. If a wedding is cancelled within the 6-month period leading up to the date, the full balance will be owed in full. We strongly advise obtaining wedding insurance to cover such an unlikely event.

DELIVERY OF IMAGES:

After the wedding, TWO-D PHOTOGRAPHY LTD. will provide copies of the best 250 images taken on the day as a minimum. At the photographer’s discretion, all other images will be provided colour-corrected and white balanced and ready for print. This normally numbers 400-600 in total. Images will be a variety of colour, black and white, and colour tones. The style of the image and will be displayed as chosen by the photographer/designer. Any changes to specific designs can be discussed and implemented up to two weeks after the wedding day itself. The images are provided as high-resolution JPEG files only. TWO-D PHOTOGRAPHY will not supply RAW files or unedited files under any circumstances. The files chosen are at the discretion of the creator. All images will be securely backed up for ONE YEAR after the wedding day. TWO-D PHOTOGRAPHY LTD. reserves the right to upload the images to a dedicated server so that guests attending on the day can log in directly and choose to purchase additional images if they should so wish to do so after the ceremony. Images must not be sold for profit or published without express permission of TWO-D PHOTOGRAPHY LTD. TWO-D PHOTOGRAPHY reserves the right to reproduce and display all images for marketing and promotional purposes.

PRE-EVENT CONSULTATION:

A pre-event consultation before the wedding date is advised to consider schedule and last-minute plans for the big day. This can be arranged at the client’s convenience but is recommended to take place at least three weeks before the wedding day itself. This can be conducted in person where possible, or via online video conferencing.

EQUIPMENT DAMAGE:

In the event any of the Photographer’s equipment being damaged or destroyed, either accidentally or intentionally, by the Client, event guests and attendants, or employees of the Client, the Client is fully responsible for the equipment’s replacement at current new market prices where the fault is not of TWO-D PHOTOGRAPHY and the claim with the photographers insurance will increase their premiums. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract.

EVENT GUIDE:

It is recommended that a member of the wedding party is made responsible for identifying people/assisting the photographers in gathering key people for set piece groupings. It is recommended a list be provided of all family members sought for photographs, so nobody is missed out! The photographer cannot be held responsible for missing anybody out on the day if assistance in this matter is not granted. Any exact requirements with regards to image content must be delivered in writing before the ceremony takes place. The photographer cannot be held responsible for any restrictions to filming, flash photography or movement within any given areas of the ceremony’s location. Restrictions must be delivered in writing before the ceremony takes place. For events involving a church ceremony or at certain other venues, the photographer’s movements are sometimes restricted by the minister or official in charge: photographing of parts or even all of the ceremony or occasion may be restricted or prohibited, as may the use of artificial lighting. The photographer cannot accept responsibility for limited coverage in such circumstances. The photographer shall not be liable in the event of guests or other vendors compromising her work.

60 MINUTE WINDOW:

The bride and groom agree to set aside at least 60 minutes (if practical) immediately after the ceremony for photographs that cannot be obtained during the ceremony or reception. This includes time for pre-agreed group set-ups of friends and family and shots of the bride and groom alone together. If for any reason outside of the photographer’s control this 60-minute window cannot take place, TWO-D PHOTOGRAPHY LTD. cannot be held liable for failure to capture desired images. This can be discussed and planned during the pre-event consultation.

For any event coverage longer than 4 hours, the Client will provide a meal for the photographer and assistant. This does not have to be a full wedding meal (As we know they are expensive!), but refreshment must be provided please. It is imperative that we are fed, where possible, before guests if we are filming speeches or setting up our studio, to allow us time to prepare for said events. If we are fed after the guests, we cannot guarantee speeches will be captured so please discuss this with your venue when discussing plans for the day. We also ask that we are served food first before guests where possible, or at the least at the same time and not last – as if we are served food after everyone else we may miss the speeches or lose time to set up our equipment.

HARRASMENT OR ABUSE

If any staff representing Two-D photography feel abused, threatened, or in danger at any point throughout the day we would withhold the right to exit the location without returning. All fees thus far received would not be eligible for a refund. Harassment or abuse includes physical, mental, name calling, sexist or religious intolerance, or any other scenario that may feel uncomfortable for those aforementioned. 

PRE-WEDDING SHOOT

All pre-wedding shoots must take place before the wedding day itself. The service cannot be transferred to a shoot post-wedding day. If under any circumstances the shoot cannot be undertaken before the wedding day, no refunds will be eligible for services paid. This shoot is for the COUPLE only but may extend to additional family/pets if agreed by both parties. The shoot must be booked in accordance with TWO-D PHOTOGRAPHY’S diary as a priority.  

MODEL RELEASE:

THE BRIDE AND GROOM hereby grant TWO-D PHOTOGRAPHY LTD. unrestricted rights to use and publish photographs of the wedding locations and guests for advertising, promotion, events, contests or any other purpose and in any manner or medium that may be appropriate. Where possible and out of courtesy, permission will be verbally given before such an occurrence.

EXCLUSIVITY/GUEST PHOTOGRAPHY:

It is understood that TWO-D PHOTOGRAPHY LTD. will act as the exclusive wedding photographer. Because of the fact that flashes from guest’s cameras may interfere with the photographer’s equipment, it is asked that at any point in the day the photographer has exclusivity and premier access to set-ups, scenarios, locations and people that as may be required as the day unfolds.

COMPLETION SCHEDULE:

Images are provided within 12 weeks of the wedding. No matter how many images are captured, the agreement is for 250 images minimum and these are of the photographer’s discretion. Our experience dictates images will be chosen for impact, beauty and the requirements therefor set out by our clients. Orders made online after the wedding by family and guests should expect a turnaround of products between 2-6 weeks.

PAYMENT:

Payment must be made by account bank transfer. We do not accept cheque or card payment. Other payment methods/details (including our preferred receipt via BACCS online transfer) can be found on the invoice.

IMAGE STORAGE:

Two-D Photography will keep all images stored on our servers for ONE YEAR from the wedding date. After this time, some data may be accessible but this cannot be guaranteed. It is the responsibility of the client to ensure all images are safely backed up in case of natural disaster / theft / USB and/or equipment failure. Two-D Photography can take no responsibility for access to images after the 12-month period has expired. If images claimed are accessible, a £100 claim fee will be charged due to images being stored off site and there being a charge for access. Once delivered Two-D Photography are not responsible for obsolete or changing technology and clients must store their photos in a way they can continue to access them. 

ALBUM DESIGN:

Should any album be included within this agreement, the client must choose their images for the agreed album, and Two-D Photography must design said album(s) within 1-year of the wedding date. After this time, a £250 admin fee will be charged to complete the album design and ordering process. This is in line with supplier price increases and inflation. 

PENALTY FEES & CHARGES:

Late payments may incur a penalty fee of £100.

LIMIT OF LIABILITY:

In the very unlikely event of death or severe medical, natural or other emergencies, it may be necessary to retain an alternative photographer. TWO-D PHOTOGRAPHY LTD. will make every effort to secure a replacement photographer if such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received before 6 months prior to the wedding date. All fees received after this time will not be refunded and are owed in full. Should the fees be outstanding, they will be owed in full. We would strongly recommend taking out wedding insurance that covers events such as these. 

TWO-D PHOTOGRAPHY LTD. takes the utmost care with respect to exposure, transportation and processing of photographs, including using professional grade equipment and backup equipment. However, in the unlikely event of ALL of the photographs being lost, stolen or destroyed for reasons within or beyond TWO-D PHOTOGRAPHY LTD.’s control, liability is limited to the return of all payments received for the event package. This does not include certain individual images that may or may not have been captured and expected on delivery, but the wedding capture in full. The delivery of images to the client is solely the decision of the creator.

If the wedding date has already been re-scheduled or the date has changed for any reason, any fees paid will not be refunded.

COPYRIGHT: 

The photographs, videos or prints produced by TWO-D PHOTOGRAPHY LTD. are protected by Copyright Law (all rights reserved) and may not be reproduced for profit without written permission. They may not be edited, re-cropped, changed, added to in any way without express permission of TWO-D PHOTOGRAPHY LTD.

Upon final payment, limited copyright ownership of the resulting images will be transferred to the client under the following conditions:

The images are property of THE COUPLE for personal use only. They may not be sold for profit to a third party without the express written permission of TWO-D PHOTOGRAPHY LTD.

The above must obtain written permission from TWO-D PHOTOGRAPHY LTD. prior to an event where the images are going to be published or sold for profit.

I have read and understood the terms above. I hereby agree to the terms of this agreement unreservedly.
